Sellers warned about 'Free' HIPs (Source: BBC Radio 4's Money Box) 'Everyone now needs to commission a HIP before selling a house Many home sellers who sign up for a free or discounted home information pack find they must pay a withdrawal fee if they change estate agent. Radio 4's Money Box has found these fees are often between £400 and £500. Estate Agents say the charges reflect the costs they incur producing the packs. But the Ombudsman for Estate Agents has warned these fees may not be payable unless they are clearly stated in the agency agreement.'

HIP is an acronym for "Home Information Pack"
The Goverment estimates that £350 million is currently lost through house purchases that fall through due to problems that only come to light in the latter stages of the sales process.
By switching the onus on to the seller to provide legal documentation and information about the condition of the property at the begining of the marketing process, the hope is that fewer prospective buyers will change their mind late in the sales process.
The Government also hopes that by putting the onus on the vendor instead of prospective buyers to supply documentation and information regarding their property, that it will stop people putting their property up for sale just to see what they would get for it. This practice is commonly known as "Testing the Market". Home Information Packs are the instrument that has been created to address these issues. From December 14th 2007 Home Information Packs will be mandatory for all Domestic Property being offered for sale to the public.
Who doesn't require a HIP?
• Properties where no marketing has taken place (e.g. sale to a member of the family) • Non-residential properties • Sale of portfolio of properties • Seasonal and Holiday accommodation • Unsafe properties and properties to be demolished • Mixed Sales (e.g. shop with flat) • Right to buy and similar sales • New homes built under park L of the Building Regulations 2006 • Properties not being sold with completely vacant possession

The Home Condition Report is designed to be an objective report on the condition of the property that can be relied upon by buyers, sellers and mortgage lenders. It will be written in Plain English in a standard format and will describe the general condition of the property taking account of its age, character and location; how energy efficient it is; and any defects or other matters requiring attention.
The Home Condition Report is designed to be a 'mid-range' survey, similar to the current Homebuyer Survey and Valuation - not as detailed as a Building Survey (sometimes known as a 'full structural survey') but a lot more extensive than a mortgage lender's valuation inspection.
